RESOLUTION 1014 (1996)
A RESOLUTION DECLARING AN EXEMPTION FROM PUBLIC BIDDING
FOR PURCHASE OF CRUSHED ROCK FOR CITY STREETS
WHEREAS, Ordinance No. 4, series 1982 establishes the City Council as the Local
Contract Review Board, and;
WHEREAS, The said Ordinance provides for an exemption to the requirement for
public bids upon finding that:
(a) It is unlikely that such an exemption will encourage favoritism in
awarding the contract or substantially diminish competition for the public
contract, and;
(b) The awarding of the public contracts pursuant to the exemption will
result is a substantial cost savings to the City, and;
WHEREAS, The contract for crushed rock is less than $10,000, and;
WHEREAS, There is only occasionally a local supplier of crushed rock, allowing
the City a reasonable purchase price and/or cost of hauling, and;
WHEREAS, The public bid process will not add to the available supply or provide
competition for supplying rock due relative small of volume rock to be purchased
by the City;
NOW THEREFORE BE IT RESOLVED, The City Council acting as the Local Contract
Review Board hereby exempts from the public bid process, the purchase of
crushed street gravel from a local supplier, up to $10,000.
