RESOLUTION 1005 (1996)
A RESOLUTION CREATING A LOCAL IMPROVEMENT DISTRICT
FOR 4TH/5th AVENUES
WHEREAS, The Union County Public Works Department will provide material, equipment
and personnel to chip-seal City streets at cost, and;
WHEREAS, The City Public Works Department has properly prepared 4th/5th Avenue
for a chip-seal surface, and;
WHEREAS, The City Council has determined that an improvement district is beneficial
to the property owners and the City.
NOW THEREFORE BE IT RESOLVED, that:
1) There is hereby created 4th/5th Avenue Improvement District, 1996, for the
purpose of constructing a chip-sealed surface on 4th/5th Avenues in accordance with
the specifications of the City, by the Union County Public Works Department.
2) The District is defined to be inclusive of all tax lots that adjoin the
following: 4th Avenue from the South line of Albany Street to the North line of
Division Street; 4th Avenue from the South line of Division Street to the North line of
Alder, (as it diagonally aligns to 5th Avenue at Alder Street); 5th Avenue from the
South line of Alder Street to the dead end of South 5th Avenue, (approximately 450
feet south of the South line of Cedar Street). A list of all tax lots and owners of
record, included within the District, is contained in the report prepared for the
purpose of this improvement district.
3) The portion of the cost of the improvement to be assessed to the property
owners, is to be assessed to the properties in the defined district specifically
benefitted thereby, on the basis of frontage of the properties on 4th/5th Avenues as
described above with adjustments made by the Council in consideration of the relative
benefit to properties in the low density residential zone, not developable for
residential use.
4) A Hearing before the City Council on the said improvement district shall be
held at the regular Council meeting on May 14, 1996 at 7:30 in the Elgin Community
Center.
5) The City Recorder is hereby directed to deposit in the mail, not less than
ten (10) days prior to the hearing, a notice of the hearing containing the information
required by the City ordinances and addressed to the owner of record of each lot to
be assessed in the improvement district.

Report for: 4th/5th Avenue Street Improvement District 1996
The Improvement District is to improve 4th/5th Avenues from Albany south to
the end of south 5th Ave. by chip-sealing the surface with three courses of chip
rock. The Union County Public Works Department will do the improvements at cost.
The estimated, cost based on last year's work, is $3.54 per frontage foot. It is
proposed to assess the properties specifically benefitted at the rate of $2.60 per
frontage foot. The City of Elgin will pay all additional costs of the improvements.
The total estimated cost for 1,700 feet is $12,040. The total amount assessed to
property owners is tentatively $7,803.60 for 3,001 front feet. Tax lots 1N39 15DA 3500,
5400, 5600, and 1N39 15 1200 are undeveloped in the low density residential zone and
are within or adjacent to wet lands and the flood plain. The Council will need to
consider these factors when assigning assessments to these properties.
