CITY OF ELGIN, OREGON
                     RESOLUTION  1008  (1996)

     A RESOLUTION DECLARING AN EXEMPTION FROM PUBLIC BIDDING
     FOR INSTALLING A CONTROL SYSTEM FOR CITY WELLS 2 AND 3

WHEREAS, Ordinance No. 4, series 1982 establishes the City Council
as the Local Contract Review Board, and;

WHEREAS,  The said Ordinance provides for an exemption to the
requirement for public bids upon finding that:
     (a) It is unlikely that such an exemption will encourage
favoritism in awarding the contract or substantially diminish
competition for the public contract;
     (b) The awarding of the public contracts pursuant to the
exemption will result is a substantial cost savings to the City.

WHEREAS,  A Request for Proposals has been sent to numerous
contractors known to the City and advertizing in the yellow pages
of telephone books in Oregon, and;

WHEREAS,  An emergency exists, in that Wells 2 and 3 are not
presently operable, and;

WHEREAS,  Completing the full public bid process will add
considerable time to the completion of the project and is not
likely to elicit a more competitive response than a Request for
Proposals, and;

WHEREAS, The public bid process will add undue expense to the City
in drafting bid specifications, and possibly increase the cost of
the bids received due to restricting various possible design
strategies;

NOW THEREFORE BE IT RESOLVED,  The City Council acting as the Local
Contract Review Board exempts the installation of Well 2 and Well
3 control system, in favor of selecting a contractor based on a
review of proposals received from competent contractors.
